(1) There will be a National Council for Environmental Protection and Climate Change Management under the chairmanship of the Prime Minister to carry out activities related to environmental protection and climate change effectively at the national level.
(2) The council under sub-section (1) shall have the following chairman and members:-
(a) Prime Minister - Chairman
(b) Minister of Forests and Environment of the Government of Nepal - Member
(c) Three Ministers of the Government of Nepal appointed by the Prime Minister - Members (d) Chief Ministers of all Provinces - Member
(e) Environmental Monitoring Member of the National Planning Commission - Member
(f) Two members including one woman nominated by the Chairman from amongst the professors of Forestry and Environmental Sciences (g) Three persons nominated by the chairman, including two women, among the people who have acquired expertise in the field of environment and climate - members
(h) Ministry of Secretary - Member-Secretary
(3) The chairman may appoint a minister from among the members as vice-chairman.
(4) The term of office of the member nominated in accordance with clauses (f) and (g) of sub-section (2) shall be three years.
(5) Notwithstanding anything contained in sub-section (4), if a nominated member does not fulfill his duties, the chairman may remove him from the position of a member at any time. But before removing him from the post, he should be given a reasonable opportunity to present his justification.
